Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("User", "you", "your") and OwnXR Inc. ("OwnXR", "we", "our", or "us"), incorporated in the State of New York, USA.

By clicking "Accept & Continue" in OwnXR's consent notice, or by otherwise accessing or using OwnXR, you agree to be bound by these Terms. If you do not agree, you may not use OwnXR.

1. Acceptance

Your acceptance of these Terms is required to use OwnXR's authenticated creator tools. Acceptance is recorded when you click "Accept & Continue" in the consent modal presented at first login. These Terms also serve as OwnXR's consent mechanism for identified analytics tracking as described in our Privacy Policy.

Viewing published OwnXR scenes does not require account creation or acceptance of these Terms. Scene viewers are not party to this agreement; their use is governed by applicable law and any terms imposed by the scene creator.

2. Eligibility

2.1 Account Holders

You must be 18 years of age or older to create an account on OwnXR. By creating an account or using OwnXR's authenticated creator tools, you represent and warrant that you meet this age requirement. Accounts found to belong to users under 18 may be terminated without notice.

2.2 Scene Viewers

Published OwnXR scenes may be viewed by individuals of any age. Viewing a scene does not require an account, and OwnXR does not collect personal data from scene viewers (see our Privacy Policy for details). Scene creators who publish content intended for children or educational audiences are responsible for ensuring their content is appropriate for the intended audience.

3. Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to:

Provide accurate and current registration information.
Notify us immediately of any unauthorized access to or use of your account.
Not share your credentials with or permit access to any unauthorized third party.

OwnXR is not liable for losses resulting from unauthorized use of your account unless caused by OwnXR's own fault.

4. Description of Service

OwnXR provides a web-based platform for:

3D Scene Composition — Create, configure, and save interactive 3D scenes using a browser-based editor.
Asset Management — Upload, organize, and manage 3D assets (models, environments, media) in your personal library.
AI-Assisted Creation — Generate or enhance 3D assets and environments using optional AI generation features (credit-based; see Section 11).
Scene Publishing — Publish scenes to a unique public link accessible via web browser, AR, and VR (with a paid subscription plan).
Immersive Viewing — Visitors of any age can explore published scenes in 3D, AR, and VR directly in their browser, without creating an account.

OwnXR is not a marketplace; published scenes and assets are not listed for sale or licensing to other platform users.

5. Content Ownership

5.1 Your Content

You retain full ownership of all 3D assets, media files, and content that you upload to OwnXR ("Your Content").

5.2 License to OwnXR

By uploading or creating content on OwnXR, you grant OwnXR a non-exclusive, worldwide, royalty-free license to store, process, display, transcode, and transmit Your Content solely as necessary to provide and operate the service for you and your designated viewers. This license terminates when you delete the content or close your account.

5.3 No Commercial Exploitation

OwnXR does not sell, license, or commercially exploit Your Content. Your Content is used exclusively to render and deliver your scenes through OwnXR's infrastructure.

6. AI-Generated Content

OwnXR offers optional AI-powered features for generating 3D assets, environments, and voice chat responses. These features are powered by third-party AI services and are subject to the following terms.

6.1 3D Asset Generation

OwnXR integrates with a third-party AI 3D generation service to allow you to create 3D models from text or image prompts. Key terms to be aware of:

Content ownership depends on the OwnXR subscription tier that underlies our integration with this provider. We disclose the material terms: if OwnXR's integration operates under a non-enterprise account with this provider, the provider may use inputs and generated outputs for training and improving their AI models. OwnXR's commercial integration is designed to minimize this exposure.
Outputs are provided "as-is" and may not be free from third-party intellectual property claims. You are responsible for reviewing generated content before use in commercial or public contexts.
You must not include personal data of yourself or others in prompts submitted to generation services.

6.2 Environment Generation (World Labs)

OwnXR integrates with World Labs Technologies, Inc. ("World Labs") to offer AI-powered 3D environment generation. By using this feature, you acknowledge the World Labs' Privacy Policy governs how World Labs processes data associated with generation requests.

6.3 Voice Chat (OpenAI)

OwnXR's Voice Chat feature is powered by OpenAI real-time voice AI technology. This feature:

Is only activated after your explicit, in-session permission.
Streams voice audio in real time to OpenAI for processing. OwnXR does not record, store, or access your audio.
Is governed by OpenAI's Terms of Use and Privacy Policy with respect to how OpenAI processes the audio stream.

6.4 General AI Disclaimer

AI-generated content may be inaccurate, biased, or non-unique. It may not qualify for intellectual property protection in all jurisdictions, and it may incorporate elements from third-party training data. OwnXR makes no warranties regarding the accuracy, fitness, or IP status of AI-generated outputs. You are solely responsible for reviewing and evaluating all AI-generated content before use, distribution, or reliance.

7. Immersive Experiences (AR/VR)

OwnXR scenes are viewable in augmented reality (AR) and virtual reality (VR) via the user's browser and native device capabilities. OwnXR does not access, record, or transmit your camera feed, motion sensors, or any other XR device data. All immersive rendering occurs locally on your device.

OwnXR uses PostHog for product analytics as described in our Privacy Policy.

Anonymous analytics (aggregate page views using ephemeral in-memory identifiers) are collected for all visitors — including unauthenticated scene viewers — without consent, as they do not constitute processing of personal data. No cookies, persistent identifiers, or device fingerprints are used. This applies equally to viewers of all ages.
Identified analytics (usage events linked to your account) are collected only after you provide explicit consent by accepting these Terms.
You may withdraw identified analytics consent at any time via Settings → Account → Withdraw analytics consent. Withdrawing consent stops future identified tracking; events already captured are retained under the legal basis that applied at the time of capture.

9. Subscriptions and Payments

9.1 Plans

OwnXR offers free and paid subscription plans. Paid plans unlock higher scene and element limits, publishing capabilities, AI generation features, voice AI, and custom subdomain support. Plan details are available on the Pricing page.

9.2 Credits

AI generation features consume OwnXR credits. Credits are allocated per subscription cycle, do not roll over, and have no monetary value outside the platform. Additional credits may be purchasable depending on plan availability.

9.3 Billing

Payments are processed by Stripe. By subscribing to a paid plan, you authorize OwnXR to charge your designated payment method on a recurring basis at the rate disclosed at purchase. Stripe's Terms of Service and Privacy Policy apply to payment processing.

9.4 Cancellation

You may cancel your subscription at any time from Settings → Subscription. Upon cancellation, you retain access to paid features until the end of your current billing period. No prorated refunds are provided except as required by applicable law.

9.5 Changes to Pricing

OwnXR may change subscription pricing. We will provide advance notice of material price changes. Continued use after the notice period constitutes acceptance.

10. Intellectual Property

OwnXR, its logo, and all original platform software, UI components, and documentation are the property of OwnXR Inc. or its licensors. You may not copy, modify, reverse engineer, or create derivative works of the OwnXR platform without our prior written consent.

All rights in OwnXR's proprietary technology are reserved.

11. Acceptable Use

You agree not to use OwnXR to:

Upload, publish, or generate content that is illegal, infringing, defamatory, fraudulent, obscene, or harmful to others.
Infringe any intellectual property rights, privacy rights, or publicity rights of any third party.
Upload content containing malware, viruses, or other malicious code.
Attempt to gain unauthorized access to OwnXR's systems, infrastructure, or other users' accounts.
Use OwnXR's AI features to train, develop, or improve AI models competitive with OwnXR or its AI service providers.
Scrape, crawl, or extract data from OwnXR through automated means without prior written authorization.
Include personally identifiable information about others in AI generation prompts.

We reserve the right to remove content and suspend or terminate accounts that violate these rules.

12. Account Termination

12.1 Termination by You

You may delete your account at any time via Settings → Account → Remove my account. Account deletion removes your profile and uploaded content from OwnXR's systems, subject to legal retention obligations.

12.2 Termination by OwnXR

OwnXR may suspend or terminate your account if you:

Materially breach these Terms.
Use OwnXR in a way that poses legal, security, or reputational risk.
Fail to pay subscription fees when due.
Are required to be removed by applicable law.

We will generally provide reasonable notice before termination unless the situation requires immediate action (e.g., security incident, legal requirement).

13. Disclaimer of Warranties

OwnXR and all content, tools, and services provided therein are offered "as-is" and "as-available", without warranty of any kind. To the fullest extent permitted by law, OwnXR disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

OwnXR does not guarantee uninterrupted availability, error-free operation, or that the platform or AI-generated outputs will meet your specific requirements.

14. Limitation of Liability

To the fullest extent permitted by applicable law, OwnXR's aggregate liability for any claim arising out of or relating to these Terms or the use of OwnXR shall not exceed the greater of (i) $100 USD or (ii) the total fees you paid to OwnXR in the 12 months preceding the claim.

In no event shall OwnXR be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with these Terms or your use of the platform, even if OwnXR has been advised of the possibility of such damages.

These limitations do not apply to liability arising from OwnXR's gross negligence or willful misconduct, or where exclusion is prohibited by applicable law.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York, USA.

If your local law requires that consumer contracts be subject to local law and courts, this section applies only to the extent not in conflict with such local law.

16. Changes to These Terms

OwnXR may revise these Terms at any time. For material changes, we will provide advance notice (for example, via in-app notification or email) before the changes take effect. Your continued use of OwnXR after the effective date of updated Terms constitutes acceptance of the revised Terms.
